Waste Collection Lambeth Terms and Conditions

These Terms and Conditions set out the basis on which Waste Collection Lambeth provides waste collection and related services to residential and commercial customers. By booking a service, you agree to be bound by these Terms and Conditions, which form a legally binding agreement between you and Waste Collection Lambeth.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, business, organisation, or other entity that requests or receives the waste collection service.

Service means any waste collection, removal, clearance, or associated service provided by Waste Collection Lambeth.

Waste means any waste, rubbish, junk, or materials presented by the Customer for collection, excluding any prohibited or hazardous items as defined in these Terms and Conditions.

Contract means the agreement between the Customer and Waste Collection Lambeth for the provision of Services in accordance with these Terms and Conditions.

2. Scope of Service

Waste Collection Lambeth provides waste collection and related services within its operational area, primarily serving customers located in and around Lambeth and neighbouring districts. The exact scope, timing and nature of the Service will be as specified in the booking confirmation issued to the Customer.

The Service may include one-off waste collection, regular scheduled collections, bulky waste removal, commercial waste services, and other related services as agreed in writing. Waste Collection Lambeth reserves the right to refuse any service request that falls outside its operational capabilities, licensing conditions, or applicable regulatory requirements.

3. Booking Process

3.1 Service requests may be made by telephone or through an online booking form or other method made available by Waste Collection Lambeth from time to time.

3.2 When placing a booking, the Customer must provide accurate and complete information, including but not limited to:

a) Full name and contact details.

b) Collection address and access information.

c) Type, approximate volume and nature of the waste to be collected.

d) Any parking or access restrictions that may affect the Service.

3.3 Waste Collection Lambeth will issue a booking confirmation setting out the agreed date or time window for collection, the indicative price, and any special conditions. The Contract is formed when the Customer accepts the booking confirmation, whether expressly or by allowing the Service to proceed.

3.4 The Customer is responsible for ensuring that all information provided during the booking process is accurate. Any inaccuracies may result in additional charges, delays, or the refusal of Service at the collection address.

4. Access and Customer Obligations

4.1 The Customer must ensure that Waste Collection Lambeth has safe, reasonable and lawful access to the collection address at the agreed time.

4.2 The Customer must ensure that:

a) Waste is clearly presented and segregated where required.

b) Any gates, doors or access points are unlocked or that appropriate arrangements for access are made in advance.

c) There is sufficient space for vehicles to stop and load without contravening parking or traffic regulations.

4.3 If Waste Collection Lambeth is unable to access the collection address or the waste due to circumstances within the Customer’s control, this may be treated as a late cancellation or failed collection, and charges may apply as set out in these Terms and Conditions.

5. Waste Types and Regulations

5.1 Waste Collection Lambeth operates in accordance with applicable UK waste management legislation and regulatory requirements. The Customer must not present any waste that is prohibited by law or by these Terms and Conditions.

5.2 Unless expressly agreed in writing in advance, the Service does not include the collection of hazardous or special waste. Prohibited items include, but are not limited to:

a) Asbestos or materials containing asbestos.

b) Clinical or medical waste, including sharps.

c) Chemicals, solvents, paints, oils, fuels or similar liquids.

d) Gas cylinders, pressurised containers, or explosives.

e) Radioactive materials or any substance classified as hazardous under applicable regulations.

5.3 The Customer is responsible for ensuring that waste presented for collection is lawful and suitable for the Service requested. If prohibited or hazardous items are discovered, Waste Collection Lambeth may:

a) Refuse to collect some or all of the waste.

b) Apply additional charges for handling, transport or disposal in accordance with legal requirements.

c) Report any unlawful activity to the relevant authorities, where required.

5.4 Waste Collection Lambeth will dispose of collected waste using authorised facilities and will seek to maximise reuse and recycling where operationally and commercially practical. However, no guarantee is given that any particular item will be reused or recycled.

6. Pricing and Payment

6.1 Service charges are based on factors such as the volume, weight, type of waste, access conditions, and the time required for collection. Prices may be quoted as fixed fees, per load, per container, or by other pricing structures as notified to the Customer.

6.2 Any price quotation given before collection is an estimate based on information supplied by the Customer. The final charge may be adjusted at the time of collection if the actual volume, type or weight of waste, or the site conditions, differ from those described during booking.

6.3 Unless otherwise agreed, payment is due on or before completion of the Service. Waste Collection Lambeth may require payment in advance or a deposit as a condition of accepting a booking.

6.4 Payment may be made by cash, debit card, credit card, or other methods accepted by Waste Collection Lambeth at the time of booking. The Customer must ensure that adequate funds are available and that any card used is authorised.

6.5 For business customers, Waste Collection Lambeth may, at its discretion, offer account terms. Where account terms are agreed, invoices are payable within the period specified on the invoice. Interest may be charged on overdue amounts at the statutory rate or such other rate as may be specified in writing.

6.6 All prices are quoted exclusive of VAT unless expressly stated otherwise. VAT will be added at the applicable rate.

7. Cancellations and Amendments

7.1 The Customer may cancel or amend a booking by contacting Waste Collection Lambeth using the contact details provided in the booking confirmation.

7.2 If the Customer cancels a booking with sufficient notice, any advance payment may be refunded, subject to any reasonable administration charges. What constitutes sufficient notice will be communicated at the time of booking and may vary depending on the nature of the Service.

7.3 If the Customer cancels with short notice, fails to provide access at the agreed time, or otherwise prevents the Service from being carried out, Waste Collection Lambeth may charge a cancellation fee or a failed collection fee, which may amount to all or a significant proportion of the quoted Service charge.

7.4 Waste Collection Lambeth reserves the right to cancel or reschedule a booking due to circumstances beyond its reasonable control, including but not limited to vehicle breakdown, severe weather, staff illness or safety concerns. In such cases, Waste Collection Lambeth will endeavour to notify the Customer as soon as practicable and will either rearrange the Service at a mutually convenient time or provide a refund of any advance payment for the affected Service.

8. Service Performance and Timeframes

8.1 Waste Collection Lambeth will use reasonable endeavours to carry out the Service on the date and within the time window agreed with the Customer. However, any times given for collection are estimates and are not guaranteed, unless expressly stated otherwise in writing.

8.2 Waste Collection Lambeth will not be liable for any loss or inconvenience suffered by the Customer arising from delays or rescheduling of collections where such delays are caused by factors outside its reasonable control.

8.3 If, on arrival at the collection address, the operative(s) reasonably consider that it would be unsafe or unlawful to carry out the Service, they may refuse or suspend the Service without liability. Reasons may include unsafe access, risk to health and safety, or breach of local traffic or parking regulations.

9. Damage and Liability

9.1 Waste Collection Lambeth will take reasonable care when carrying out the Service to avoid damage to property. However, the Customer is responsible for protecting any surfaces, fixtures, fittings, or items that could reasonably be at risk during normal waste collection activities.

9.2 Waste Collection Lambeth is not liable for:

a) Normal wear and tear or minor cosmetic damage resulting from the movement of waste items.

b) Damage arising from inherent defects or weaknesses in items being removed or in the Customer’s property.

c) Loss or damage caused by inaccurate information supplied by the Customer.

9.3 Nothing in these Terms and Conditions limits or excludes Waste Collection Lambeth’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

9.4 Subject to the above, Waste Collection Lambeth’s total liability to the Customer for all claims arising out of or in connection with the Contract, whether in contract, tort, negligence or otherwise, shall be limited to the total amount paid or payable by the Customer for the specific Service giving rise to the claim.

9.5 Waste Collection Lambeth will not be liable for any loss of profit, loss of business, loss of data, loss of goodwill, or any indirect or consequential losses, whether arising from delay, non-performance, or otherwise.

10. Customer Warranties and Indemnity

10.1 The Customer warrants that:

a) They are the owner of the waste or have full authority from the owner to arrange its removal.

b) The waste presented is not hazardous or prohibited, unless expressly agreed in writing.

c) The information supplied to Waste Collection Lambeth about the nature, quantity and location of the waste is accurate and complete.

10.2 The Customer agrees to indemnify Waste Collection Lambeth against any claims, costs, fines, or losses incurred as a result of a breach of these warranties, including any costs associated with the handling or lawful disposal of prohibited or hazardous waste not disclosed at the time of booking.

11. Complaints and Dispute Resolution

11.1 Waste Collection Lambeth aims to provide a professional and reliable waste collection service. If the Customer is dissatisfied for any reason, they should contact Waste Collection Lambeth as soon as possible, providing details of the issue and the date of the Service.

11.2 Waste Collection Lambeth will investigate any complaint and may request further information or evidence. Where a complaint is upheld, Waste Collection Lambeth may, at its discretion, offer a partial refund, a re-visit, or another form of reasonable remedy.

11.3 If a dispute cannot be resolved through informal discussions, the parties may consider mediation or other forms of alternative dispute resolution before commencing legal proceedings, where appropriate.

12. Data Protection and Privacy

12.1 Waste Collection Lambeth will collect and use personal data provided by the Customer in order to process bookings, deliver Services, manage accounts, and comply with legal obligations.

12.2 Personal data will be handled in accordance with applicable UK data protection laws. Waste Collection Lambeth will take reasonable steps to protect personal data from unauthorised access, loss or misuse and will only retain such data for as long as necessary for the purposes for which it was collected or as required by law.

13. Variation of Terms

13.1 Waste Collection Lambeth may amend these Terms and Conditions from time to time. The version in force at the time of the Customer’s booking will apply to the Contract for that Service.

13.2 Any significant changes to these Terms and Conditions will be made available upon request or via the usual communication channels used by Waste Collection Lambeth.

14. Severability

14.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed removed to the minimum extent necessary so that the remaining provisions continue in full force and effect.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Contract, including any non-contractual disputes or claims.

By placing a booking with Waste Collection Lambeth, the Customer confirms that they have read, understood and agree to be bound by these Terms and Conditions.
